2. Nature of Services

Nivasaya acts solely as a facilitator and mediator platform that connects Clients with independent Professionals.

We:

  • Do not directly provide construction, interior, renovation, or related services.
  • Do not employ Contractors or Interior Designers.
  • Do not supervise or control project execution.
  • Do not guarantee project outcomes.

All services are delivered independently by the selected Professional.

3. Independent Relationship

Upon successful matching:

  • The Client and Professional enter into a direct and independent agreement.
  • Nivasaya is not a party to that contract.
  • Any pricing, timelines, specifications, scope of work, or payment terms are decided solely between Client and Professional.

Nivasaya shall not be liable for:

  • Quality of work
  • Delays
  • Cost overruns
  • Damages
  • Contractual disputes
  • Payment disputes

4. Mandatory Independent Agreement

After a successful match:

  1. The Client and Professional are required to execute a separate written agreement governing:
    • Scope of work
    • Payment terms
    • Timeline
    • Materials
    • Dispute resolution
  2. This agreement shall clearly state that:
    • Nivasaya is only a mediator and referral platform.
    • Nivasaya is not responsible for project execution or contractual obligations.
  3. Both parties acknowledge that Nivasaya’s role ends at facilitating the introduction, except for providing support assistance if requested.

5. Support Role of Nivasaya

Although Nivasaya is not contractually responsible for project delivery, we may:

  • Provide coordination assistance
  • Help with communication facilitation
  • Offer general guidance if disputes arise
  • Suggest possible resolution methods

However:

  • Nivasaya is not legally obligated to enforce project contracts.
  • We do not act as an arbitrator unless explicitly agreed in writing.
  • Support is advisory in nature only.

6. User Responsibilities – Clients

Clients agree to:

  • Provide accurate project details
  • Conduct their own due diligence before hiring
  • Enter into a written agreement with the Professional
  • Make payments directly to the Professional (unless otherwise agreed)
  • Verify licenses or credentials independently

Clients understand that Nivasaya does not guarantee results.

7. User Responsibilities – Professionals

Professionals agree to:

  • Provide accurate business and experience information
  • Perform services ethically and lawfully
  • Comply with applicable local laws and regulations
  • Deliver services as per their agreement with the Client
  • Maintain proper communication and professionalism

Professionals acknowledge that they are independent entities and not employees, partners, or agents of Nivasaya.

8. Payments

Unless otherwise stated:

  • Nivasaya does not collect project payments on behalf of Professionals.
  • Payments are made directly between Client and Professional.
  • Any commission or service fee arrangement (if applicable) shall be separately agreed upon.

Nivasaya is not responsible for:

  • Non-payment
  • Delayed payments
  • Financial disputes

9. Limitation of Liability

To the fullest extent permitted by law:

Nivasaya shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Project losses
  • Property damage
  • Personal injury
  • Professional negligence
  • Misrepresentation by any party
  • Breach of contract between Client and Professional

Users agree that they engage with each other at their own risk.

10. Verification Disclaimer

While Nivasaya may perform basic screening of Professionals, we do not guarantee:

  • Licensing validity
  • Skill level
  • Financial stability
  • Legal compliance
  • Background checks

Users are advised to independently verify credentials before entering into agreements.

11. Dispute Resolution

In case of disputes:

  • Clients and Professionals must attempt to resolve matters directly.
  • Nivasaya may assist in communication if requested.
  • Nivasaya is not legally responsible for enforcing outcomes.

Any legal disputes shall be subject to the jurisdiction of courts located in India.

12. Intellectual Property

All website content including:

  • Logos
  • Branding
  • Text
  • Graphics
  • Design elements

are the intellectual property of Nivasaya and may not be copied or reproduced without permission.

13. Termination of Access

Nivasaya reserves the right to:

  • Suspend or remove users
  • Restrict access
  • Refuse service

If users violate these Terms or engage in fraudulent or harmful activity.
